Parents in Germany Can Lose Custody if They Fail to Protect Their Children

Jakarta, ThedailyID — Parents in Germany can lose custody of their children if they fail to protect them from serious risks. Family courts can intervene when parents cannot or will not protect a child’s physical, mental, or emotional well-being.

Courts consider the severity of each case before deciding what action to take. They may restrict certain parental rights or revoke custody entirely. However, they must consider other ways to protect the child first.

Germany’s Federal Statistical Office (Destatis) reported 14,684 cases of partial or full custody revocation in 2025. Courts fully revoked custody in 7,045 cases. The remaining 7,639 cases involved partial revocation.

How Germany’s Custody Laws Work

German family courts can intervene when a child faces threats to their well-being. They may also require parents to seek help from public child welfare or health services.

Removing a child from their family is not an automatic response to parenting problems. Authorities must consider whether government assistance or other measures can address the risks.

Courts can revoke all parental custody only when other measures have failed or cannot adequately protect the child.

Cases That Led to Intervention

In January 2026, authorities in Menden, Germany, temporarily separated six children from their parents after concerns arose about their living conditions.

According to Deutschlandfunk, a passerby spotted a two-year-old outside in freezing weather. The child wore only light clothing and had no shoes. Officials then inspected the family’s home and found five other children.

All six children underwent medical examinations. Doctors found that they were developing according to their ages and showed no signs of physical abuse. However, the local child and youth welfare authority, known as Jugendamt, temporarily removed them because of concerns about their care.

Another case occurred in Stade, Lower Saxony, in April 2026. A baby girl arrived at a hospital with a brain hemorrhage. Doctors suspected shaken baby syndrome, a serious injury that can result from violently shaking an infant.

Following the medical findings, authorities revoked the parents’ custody rights. The mother and baby initially stayed together at a child and youth welfare facility. Later expert examinations strengthened suspicions that shaking had caused the infant’s injuries.

These cases show how German authorities intervene when they believe a child faces danger. The courts use custody revocation as a protective measure, not as an automatic punishment for parenting mistakes.
