Jakarta, ThedailyID — All nine Indonesian Constitutional Court judges have been reported to the Constitutional Court Ethics Council, or MKMK, over their handling of a 2024 election dispute involving Vice President Gibran Rakabuming Raka.
The complaint came from Forum Mahasiswa Indonesia chairman Pian Andreo Halomoan Manurung. He filed the report over Case No. 01/PHPU.PRES-XXIV/2026.
The complainant accused the judges of violating judicial independence. He alleged that the court used its authority to show Gibran’s diploma to Denny Indrayana, one of the petitioners in the case.
Lawyer Saddan Sitorus presented the allegation during the MKMK’s preliminary hearing on Wednesday, October 7, 2026. He also alleged that Indrayana had previously offered a financial reward related to displaying Gibran’s diploma.
The complaint argues that constitutional judges should remain independent from public pressure, media coverage, and the parties involved in a case.
The complainant also questioned the court’s decision to proceed with evidentiary hearings. He argued that the judges should have first examined the petition before moving directly into evidence hearings.
The complaint further alleged pressure from political interests and public attention surrounding questions about Gibran’s educational qualifications. However, these remain allegations made by the complainant.
The MKMK has registered the report as No. 05/MKMK/L/10/2026. The council held its preliminary examination on October 7, with the complainant providing statements and evidence.
The complainant asked the MKMK to form an independent expert team. He also requested an objective and neutral examination under the Constitutional Court’s ethics rules.
Among the requested measures, the complainant asked the MKMK to temporarily halt the PHPU case. He also sought permanent dismissal of the judges if the ethics panel finds them guilty.
However, the PHPU case had already reached its final stage. The Constitutional Court issued its ruling on October 6, 2026.
In that ruling, the court declared the petition inadmissible after granting the KPU’s objection concerning the petitioners’ legal standing. The court also found that the issue raised by the petitioners did not fall within the proper scope of a presidential election results dispute.
The petitioners included the Independent Election Monitoring Committee, Partai Ummat, Denny Indrayana, and several individuals from the Forum Purnawirawan Prajurit TNI. They had challenged Gibran’s educational qualifications as a vice-presidential candidate in the 2024 election.
